Amendments to HedgeStreet Rule 1.1(c) relating to location of fee schedule and Rules 4.4, 5.4 and 5.5 relating to Market Maker orders
The HedgeStreet Rule Committee has approved revisions to HedgeStreet Rules 4.4, 5.4 and 5.5, which allows Market Makers to place both buy and sell orders in the order book without having the necessary funds/contracts at the time the order is entered. Instead, for sell orders, the market maker must have those contracts in its account at the time the order is executed or must have sufficient funds to subscribe for the number of Hedgelet Pairs necessary to fill that sell order at the time the order is executed. Conversely, for buy orders, market makers must have sufficient funds to purchase the number of Contracts necessary to fill the buy order at the time the order is executed. The HedgeStreet Rule Committee has amended HedgeStreet Rule 1.1(c) to stipulate that HedgeStreet's fee schedule is available on HedgeStreet's website. View the rule changes.

Amendments to HedgeStreet Rules 5.4(b)-(d) and 5.5(d) and the addition of Rule 5.4(e) relating to Market Maker Orders
The HedgeStreet Rule Committee has approved revisions to HedgeStreet Rules 5.4(b)-(d) and 5.5(d) and added new Rule 5.4(e), allowing a Market Maker to enter Market Maker Orders, for both Long and Short Variable Payout Hedgelets for which a Market Maker does not have an offsetting position. A Market Maker's account will not be debited the requisite amount of funds until a trade is executed on the market. Once the trade is matched on the market, HedgeStreet will automatically deduct the requisite amount of funds to cover the maximum potential loss from the Market Maker's account. The proposed installment of a Monthly Survey Program ("Program") will be offered to visitors of the HedgeStreet web site. There is no obligation to complete the survey nor is there an obligation to become a member. In accordance with Commission Regulation 40.6, the HedgeStreet Rule Committee ("HedgeStreet") has approved a change in the name of a Series of Currency Exchange Contracts from Daily Contract (Old) to Spot Contract (New) and established the new definition of Spot Contract. HedgeStreet also approved the amendments to the existing terms and conditions of the Gold Fixed-Payout Hedgelets, as defined under Rule 12.10. Further to these amendments, on November 22, 2004 HedgeStreet intends to issue new Spot Gold Fixed-Payout Contracts, which were resultantly added. This new instrument is offered and represented by new Rule 12.29. A description of an unbaised methodology for determining settlement values to be used on the HedgeStreet Exchange was also reviewed and approved along with the listing of this new product. Additionally, amendments to Crude Oil Fixed-Payout Hedgelet Contracts and the manner in which the expiration value for certain of those Contracts is to be calculated were effected.

Notice of Amendments to Rules 4.4(c), 5.4 and 5.5(d), effective March 1, 2005
Pursuant to Commission Regulation 40.6 (a)(2) and (3), the HedgeStreet Rule Committee has approved amendments to Rules 4.4(c), 5.4 and 5.5(d), in order to i) ensure full collateralization of Variable Payout Hedgelets upon trade execution; ii) employ the same process of debiting cash upon trade execution for Fixed Payout Hedgelets; and iii) remove Market Maker a) buy orders and b) sell orders to which the market maker has an offsetting transaction from the HedgeStreet Rules. The process of Subscription on Demand will still be available to Market Makers.
Said amendments require that all members have sufficient funds to satisfy their trading obligations in both Variable Payout and Fixed Payout Hedgelets upon the execution of any trade (instead of blocking cash upon order entry). As such, HedgeStreet will also be imposing a $10 Insufficient Funds Fee any time a member enters an order that is matched by another member but is rejected because he/she did not have sufficient funds to cover the transaction prior to execution.
These Rule amendments were submitted to the Commission on Wednesday, February 9, 2005.

The Initial Minimum Deposit Requirement is reduced from $500 to $100 and the new Active Trader Pricing Schedule is initiated on Wednesday, May 11, 2005
Pursuant to Commission Regulation §40.6, the HedgeStreet Rule Committee has approved the amendment of Rule 3.1(b) which now features the new initial deposit requirement of $100. Additionally, an Active Trader Pricing Schedule is established such that a) the Minimum Trading Fee of $5.00 for Standard Pricing is replaced with $0.00. (Standard Traders are Members that do not qualify for Active Trader Pricing); b) beginning in the month of April 2005, any Member that traded more than 20 times in a calendar month is qualified to receive Active Trader Pricing; and c) if, while receiving Active Trader Pricing, a Member does not execute 60 trades in 2 successive calendar quarters, the member will be changed from an active trading status to standard pricing status. Data Release of Expiration Values is Delayed by Source Agency for HedgeStreet's WEEKLY Gasoline, California Gas, and Diesel Products, due to the Columbus Day Holiday on Monday, October 10, 2005
Due to Columbus Day, the EIA will not be releasing data for Gasoline, California Gas or Diesel on Monday, October 10th. Rather, the expiration values used to settle these contracts will anticipate release on the following business day, Tuesday October 11th. In light of this change, HedgeStreet is extending the Last Trading Day for these weekly contracts by one day only.
Therefore, the Last Trading Day originally scheduled for these weekly contracts on Friday, October 7, 2005 (Old) will now be extended to a Last Trading Day of Monday, October 10, 2005 (New). Settlement for the weekly products will then occur on Tuesday, October 11, 2005 as the EIA intends to release its data on this date.
As a result, the following week's contracts will have a minimized trading schedule, only trading from Wednesday, October 12, 2005 through Friday, October 14, 2005 (Last Trading Day). Since the Last Trading Day for these weekly contracts will revert back to scheduled time, settlement will also resume on Monday October 17, 2005, as usual.

Additionally, HedgeStreet is changing the Underlying of its Consumer Price Index ("CPI") Hedgelets by switching from the non-seasonally adjusted CPI for all Urban Consumers to the seasonally-adjusted CPI for all Urban Consumers as reported by the US Department of Labor's Bureau of Labor Statistics.

HedgeStreet Amends Rule 1.1(a), Increases the Maximum Settlement Value for Various Binary Contracts from $10 to $100, and Modifies the Minimum Tick Size in the Same Contracts
Pursuant to Commission Regulation §40.6(a), the HedgeStreet Rule and Instrument Committees have approved the above-referenced actions.
As a result of the increase in the maximum Settlement Value amount, HedgeStreet is amending the reporting level for these Contracts and the Minimum Tick size in order to accommodate the larger maximum Settlement Value.
HedgeStreet will first issue the Contracts with the increased Settlement Value and Minimum Tick size on Wednesday, November 1, 2006. Since the current Contracts that have a Settlement Value of $10 and a Minimum Tick of $.05 have a Last Trade Date of Tuesday, October 31, 2006, there will be no open interest in such Contracts upon the close of business on Tuesday, October 31, 2006.

The current Special Free Trade Promotional Offer (the "Promotion") grants participating HedgeStreet Members free trades over a period of 30 calendar days (to commence upon the time that the member's funds have been deposited for the first time, settled into their account, and such funds are deemed available for use towards trade).
